Medical Malpractice Terms and Definitions

 

 

Arbitration
A process for deciding a legal dispute out of court; a substitute for an ordinary trial.

Stipulation
An agreement, admission or concession made in a judicial proceeding by the parties or their attorneys, thus relieving a party of its obligation to produce evidence in support of an argument or allegation.

Miscarriage
When circumstances cause the mother's body to react to a problem in the pregnancy. This may cause bleeding, cramping, and will ultimately cause the loss of the pregnancy.

Medical Treatment
Lawsuits related to medical treatment are triggered by a number of causes, including failure to select the correct treatment or to monitor or follow up on the patient's condition.

Statute of limitations
A statute specifying the period of time after the occurrence of an injury--or, in some cases, after the discovery of the injury or of its cause--during which any suit must be filed.

Spinal cord abscess
Spinal cord abscess is a disorder characterized by inflammation and a collection of infected material (pus) around the spinal cord.

Medications Malpractice
This category covers claims arising from inaccurate medication prescriptions, such as wrong medication or dosage level.

Collateral source rule
Under this rule, compensation awarded to an injured party shall not be reduced by the amount of compensation available to him from his insurance company or other independent sources.

Medical negligence
Failure of a physician or other medical personnel to meet the standards of conduct for duties relating to the medical profession. Those standards are based on what a reasonable person with the requisite knowledge and skills would or would not do.

Anesthesia
A large class of claims related to anesthesia has resulted from cases where the anesthesiologist or anesthetist did not take a complete medical history of angina, myocardial infarction, recent upper respiratory infection, and asthma.

    Definition:
    Failure to exercise that degree of care that a reasonable person would exercise under the same circumstances. When that failure causes another person to suffer an injury or financial loss, that person may be entitled to just compensation through our civil justice system.

    Statute of limitations

    Definition:

    Definition:
    A process by which a third party is put in the place of a creditor so that the rights and securities of the creditor pass to that third person.
